Here are some answers to the questions that we have been asked regarding fictitious business name (DBA) filing-

Q: What is DBA or Fictitious Business Name?
Ans:  

• According to Civil Code 2466 Every person or partnership transacting business in this State under a fictitious business name must file with the clerk of the county in which his or its principal place of business is situated*
• According to Section 17924 Business & Professions Code, Fictitious business name statements must be published in a newspaper within 30 days after the statement has been filed with the county clerk recorder. The statement should be published in a County's adjudicated newspaper*

Q: Why file DBA or Fictitious Business Name statement?
Ans:  

• To open a business account with a bank.
• To protect your business name from being used by someone else.

Q: Who need to file a DBA or Fictitious Business Name?
Ans: Persons who want to start a business other than their own name OR the Corporations, LLC's operating business on other names need to file doing business as statement with County Clerk.

Example: "Jacobsen and Co. Gardening" would require filing doing business as.

Q: When Fictitious Business Name is required?
Ans: Any person who regularly transacts business for profit, under a fictitious business name, is required to file a fictitious business name statement with the Recorder/County Clerk. Fictitious business names are filed in the same county where the business is located.

Q: What if I have changed address or owner's name?
Ans: You will need to re-file and re-publish your dba exactly like a new filing.

Q: How much time it take you to file?

Q: When does a filed fictitious name statement expire?
Ans: 

• A fictitious business name statement expires five (5) years from the date it was filed in the office of the County Clerk Recorder.
• The statement expires upon the filing of a statement of abandonment.
